A judge ruled Monday that the proposed sale of a 20-percent interest in reigning Horse of the Year Curlin (Smart Strike) will not go through, according to published reports. Curlin's majority owner, Stonestreet Stable's Jess Jackson, had offered to buy out embattled co-owners Shirley Cunningham and William Gallion, who raced as Midnight Cry Stables, for $4 million. But circuit judge Roger Crittenden ruled against that sale after lawyers representing Cunningham and Gallion objected, saying the offer was too low.
