P Visa Expansion for Equine Workers: What's Currently Known?

It's a piece of legislation not introduced yet, but that didn't stop two industry leaders from discussing at last week's racing symposium in Arizona a proposed immigration change that could alter the way the sport's workforce seeks employment here legally. At the symposium, Horseracing Integrity and Safety Act (HISA) CEO Lisa Lazarus reportedly discussed a plan to expand P Visas to include equine workers with a built-in funding mechanism for the organization, according to BloodHorse. Currently, the backstretch workforce falls under the umbrella of the Fair Labor Standards Act, limiting...

Immigration Reform: “It's Insanely Difficult”

Tuesday's immigration raid at Delta Downs--which resulted in the reported apprehension of 84 undocumented individuals--reminds industry stakeholders once again of a frustrating conundrum. On the one hand, they must navigate an environment of ramped-up immigration enforcement, and the potential that what happened at Delta Downs could happen at any other racetrack around the country. On the other, they face a long-broken system that makes sourcing legal immigrant workers a bureaucratic nightmare. "It's insanely difficult," said trainer Doug O'Neill, about a visa system that's necessary to properly staff the racetrack backstretch....

Immigration Enforcement Descend Upon Delta Downs

Immigration enforcement officers raided the Delta Downs racetrack Tuesday morning in what has been described as a sweep of the backstretch, which had been closed off by the authorities. The raid, involving drones, was coordinated between Immigration and Customs Enforcement (ICE), state and local law enforcement agencies, according to several sources. In the latest development in an evolving situation, "several dozen individuals" have been detained at the track as part of the raid, said Eric Hamelback, CEO of the national Horsemen's Benevolent and Protective Association (HBPA). Delta Downs' latest Thoroughbred...

Amid Immigration Crackdown, Possible Opportunity For Immigrant Backstretch Workers

Major immigration reform has been talked about for decades, but torpedoed legislation is as far as that has gone. Indeed, President Ronald Reagan was still just in his second term when he signed the last comprehensive immigration reform bill successfully steered through Congress. Amid the cavalcade of immigration-related actions that the current administration has sanctioned, however, the possibility has appeared for that trend to be bucked. In the process, it opens the door for some of the nation's backstretch immigrant workforce to potentially find themselves on a new pathway towards...

NTRA's Rooney Confident Trump Will Leave Backstretches And Farms Alone But Fear Still Widespread Within The Sport

by Bill Finley and Dan Ross Throughout his campaign, President Donald Trump vowed to crack down on illegal immigrants, a promise he has kept during the first few weeks of his new administration. That has created much uncertainly on the backstretches of the nation's racetracks and at the horse farms spread across the country, both of which rely heavily on foreign labor. Should the U.S. Immigration and Customs Enforcement (ICE) set its sights on racing and start deporting backstretch employees that would mean a major crisis for a sport. A former...

Florida Trainers Sure to Feel Impact of Draconian New Immigration Law

Last month, Florida Governor Ron DeSantis signed into state law the self-described "strongest anti-illegal immigration legislation in the country." Under the new statute--the bulk of which goes into effect on July 1--business owners with 25 or more employees must use E-Verify to confirm the immigration status of new hires, and be subjected to enforceable penalties for employing undocumented workers, as well as stricter penalties for sending undocumented workers across state lines to work in Florida, among other provisions. When enforced, the new stringent laws are highly likely to impact everyone...
