NYS Gaming Commission Chair Calls For Trainer Accountability On Employee Wage Issues

At a public meeting Oct. 3 of the New York State Gaming Commission, Chairman Brian O'Dwyer addressed concerns regarding wage issues involving prominent horse trainers and highlighted a partnership with the New York State Department of Labor to readily identify any licensees that are subjects of labor wage-related investigations, the commission said in a press release early Friday morning. New York State Department of Labor Commissioner Roberta Reardon said, "We remain dedicated to ensuring that hardworking New Yorkers receive wages they rightfully earned. I thank the New York Gaming Commission...

The Week in Review: After a Nightmare, Ray Handal Returns to the Winner's Circle

It was just a claiming race, but when Ray Handal was standing in the Saratoga winner's circle Friday after a win by his Thinkaboutit (Upstart) in the day's eighth race, he was overcome with emotion. It was a victory he will never forget, understandable considering what he had just been put through. "A short time before that, I didn't know if I'd ever be in the winner's circle again," the 34-year-old trainer said. "To come back and win with a horse who we didn't have much in the way of...

Pletcher Hit With Suspension for Bute Positive

The New York Gaming Commission has suspended Hall of Fame trainer Todd Pletcher 14 days and fined him $2,000 after a horse he trained tested positive for the non-steroidal anti-inflammatory phenylbutazone during a 2022 race at Saratoga. Via text message, Pletcher said he is appealing the penalty. He declined to comment further. The Paulick Report was first with the story. The horse in question, Capensis (Tapit), was the even-money favorite in the 10th race at Saratoga on July 30, 2022 and finished sixth. He is owned by Eclipse Thoroughbred Partners,...

Rick Dutrow Returns to Work

Rick Dutrow was on the Belmont backstretch Tuesday morning preparing for the rest of his career after an absence of more than ten years, the result of his license being revoked by the New York racing authorities. Dutrow had his license reinstated by the New York Gaming Commission on Feb. 27, but said that Tuesday was his first day back at work. "They gave me stalls in barn 28," Dutrow said. "They allowed me to come back [Tuesday]. It was mid-day and I went straight to the barn to set...

The Week in Review: Suspension of NYRA Clocker a Disgrace

The New York Gaming Commission has made so many bad decisions of late that it would be laughable if not for the fact they keep going after good people who have done nothing wrong. The latest chapter is the story of NYRA clocker Richie Gazer. Back in May, Gazer was handed a 30-day suspension and fined $2,500 "for altering a published work of a horse to make the horse eligible to race." The horse in question, Papi On Ice (Keen Ice) was originally credited for a five-furlong workout on May...

The Week in Review: Nest Belongs in the Travers

For Nest (Curlin), the easy route to the Breeders' Cup includes a stop in the GI Alabama Aug 20. It's a prestigious race, has a $600,000 purse and Nest would be an odds-on favorite against many of the same horses she thrashed Saturday in the GI Coaching Club American Oaks. But what fun is that? Owners Mike Repole, Michael House and Eclipse Thoroughbred Partners and trainer Todd Pletcher have already shown that they will think outside the box. They ran their filly in the GI Belmont S., where she finished...

NY Gaming Commission Upholds Void of Claim

A hearing officer for the New York Gaming Commission has upheld the voided claim of Battalion (Tiznow) in the fourth race at Belmont Park, May 28. Bella Mia Stables LLC and their trainer Bob Klesaris had entered the horse into the race with a $25,000 claiming tag. When owner Sanford Goldfarb and trainer Robert Atras claimed the horse, no one notified the Klesaris barn and the horse was returned to their barn, rather than the test barn. The New York Stewards decided to void the claim, and Michael De Bella,...

Op/Ed: NY Gaming Commission Gets It Wrong..Again

When the news was reported earlier in the week that a NYRA clocker had been charged with altering a published workout, it may have seemed at first that a significant penalty was in order. Workouts are an important part of a horse's history and gamblers must be able to have trust in their accuracy. The New York Gaming Commission is alleging that clocker Richie Gazer played around with the workout of a horse named Papi On Ice (Keen Ice) and suspended him for 30 days and fined him $2,500.  He...

Miceli Suspended 30 Days

Trainer Mike Miceli has been suspended 30 days and fined $2,500 by the New York Gaming Commission for failing to follow Commission rules pertaining to the horse Cover Photo after a win in a $10,000 claiming race Mar. 13 at Aqueduct. The horse raced within 14 days of receiving a joint injection, which violates Commission rules. Cover Photo was not disqualified from her victory. Miceli will begin his suspension May 8 and, according to the DRF, bloodstock agent Joe Brocklebank will take over in his absence, granted he passes his trainer's...

Potts Faces Lengthy Suspension After Drug Found in His Tackroom

Embattled trainer Wayne Potts was hit with a 45-day suspension Sunday by the New York Gaming Commission, which charged that a drug found in his tackroom was not approved by the FDA for use in Thoroughbred horses. The suspension is set to begin Apr. 10. Potts has waived his right to an appeal. The drug was found Feb. 17. The New York regulators decided to divide up Potts's 45 day-suspension so that it correlates with still another suspension he is facing, one from the New Jersey Racing Commission. In January,...

The Week in Review: Time to Bring the Hammer Down on The Juice Man

The Jorge Navarro case was back in the news last week as lawyers representing the federal government submitted a sentencing letter regarding the disgraced trainer to Judge Mary Kay Vyskocil. They recommended that Navarro get the maximum allowable sentence for doping racehorses under his care, five years. He will be sentenced Friday. The government lawyers did their job and they did it well, and they want no mercy for the Juice Man. Read the sentencing letter and the first conclusion you will come to is probably the same one I...

Temporary Injunction Allows Rice to Resume Training

A New York court has granted Linda Rice a temporary injunction that allows her to resume training while she pursues a legal appeal of the three-year license revocation and $50,000 fine for "improper and corrupt conduct" levied against her by the New York State Gaming Commission (NYSGC). The ban went into effect Monday. Later on June 7, Rice's legal team filed a complaint in the Schenectady County Supreme Court alleging that the penalty is "unduly harsh." Daily Racing Form first reported the June 9 granting of the injunction. TDN could...
