Anti-HISA Lawsuit By Three States Asks For Yet Another Go Before Supreme Court

The states of Oklahoma, West Virginia and Louisiana-which for the past five years have been unable to prove their allegations that the Horseracing and Safety Integrity Act (HISA) is unconstitutional at either the United States district court, federal appeals court, or the Supreme Court levels-are now petitioning the Supreme Court for a yet another chance to make their case that the law purportedly gives a private corporation too-broad powers to regulate Thoroughbred racing. This latest petition for a "writ of certiorari" (the formal term for asking the Supreme Court to...

Sixth Circuit Affirms HISA's Constitutionality A Second Time

For the second time in 2 1/2 years, the same panel of three judges on the Sixth Circuit of the U.S. Court of Appeals in Cincinnati has affirmed the constitutionality of the Horseracing and Safety Integrity Act (HISA) in a lawsuit spearheaded by the states of Oklahoma, West Virginia and Louisiana. The case had alleged that the HISA Act gave a private corporation--the HISA Authority, which operates under the auspices of the Federal Trade Commission (FTC)--far too broad regulatory authority. The plaintiffs claimed that was a violation of the non-delegation...

'26 Dates Set For Charles Town And Mountaineer

Both Charles Town Races (165 dates) and Mountaineer Park (125 dates) got approval Dec. 16 from the West Virginia Racing Commission (WVRC) to finalize live racing schedules for 2026. The awarding of race dates in West Virginia is annually an outdated, several step process. A state statute requires Charles Town to apply for 220 programs every year, and Mountaineer is required to apply for 210 dates. But those quotas haven't been reached for quite some time. So what has ended up happening in recent seasons is that after the initial...

Fixed Odds Wagering Bill Filed In West Virginia

A bill that would authorize fixed odds betting on Thoroughbred and greyhound racing was filed Monday in the West Virginia Senate. If enacted, 5% of each licensee's adjusted gross wagering receipts from fixed odds wagering would go to a fund to supplement purses for Thoroughbreds and greyhounds. The money bet via Thoroughbred fixed odds would go to Thoroughbred purses; the greyhound revenue would be earmarked for greyhound purses. According to the text of Senate Bill 576, "Any content authorized for fixed odds wagering on horse races from West Virginia, or...

Letter to the Editor: The Thoroughbred Industry is in Grave Danger

I read with interest the article of The Thoroughbred Report titled "Dogs Gone: New Zealand bans greyhound racing from 2026," dated Dec. 12. The article starts with the sentence, "There are only five nations globally where greyhound racing still operates being New Zealand, USA, Ireland, Australia, and Britain, but this is set to change with an announcement by New Zealand MP Winston Peters that greyhound racing will be banned in NZ from 2026." I was not aware that racing greyhounds is still legal in the United States. According to Wikipedia,...

Off At 1-10 Odds, West Virginia Filly's One-Year Win Streak Halted By Uncoupled Stablemate

The West Virginia-bred filly Direct the Cat (Redirect), who was profiled in TDN earlier this month after winning six straight races by a combined 58 3/4 lengths, had her year-long, huge-margin win streak stopped Saturday night when she ran second at Charles Town in the $75,000 Sylvia Bishop Memorial S. for state-bred 3-year-old fillies. The 1 3/4-length defeat was administered by the 12-1 upsetter and second choice in the wagering, Overnight Pow Wow (Fiber Sonde). The two gray fillies are both owned and trained by Cyndy McKee, who, along with...

HISA Arbitrator Wipes Out 2-year Suspension for 76-year-old trainer in Isoxsuprine Contamination Case

The West Virginia-based trainer Dennis VanMeter won a Horseracing Integrity and Safety Authority (HISA) arbitration judgment Sept. 26 that wipes out a two-year negligence suspension and $25,000 fine related to an adverse analytical finding for the banned substance isoxsuprine in a shipper, Templement (Flatter), who ran sixth and last in an allowance sprint at Thistledown in Ohio on June 7. Although the final order signed by arbitrator Laura Abrahamson noted that VanMeter did not contest the isoxsuprine finding itself and that he must still bear responsibility for that violation found...

The United States Court of Appeals for the Sixth Circuit ruled Thursday that it will not grant a full-court rehearing to the losing plaintiffs who contested a three-judge panel's Mar. 3 decision to uphold the constitutionality of the Horse Racing Integrity and Safety Act (HISA). The case is one of five anti-HISA constitutionality lawsuits currently active in the federal court system. Led by the states of Oklahoma, West Virginia and Louisiana, the plaintiffs collectively petitioned Apr. 17 for a rarely granted "en banc" procedure that asked for a rehearing before...
